Chapter 13 is a reorganization or debt consolidation. In Chapter 13, you make a monthly payment to the Chapter 13 Trustee for up to 5 years and the Trustee pays your creditors according to the Plan that you propose and is approved by the Court. Chapter 13 allows the curing of mortgage arrears and the restructuring of secured debts so that you do not lose your property.
Chapter 7 is a liquidating bankruptcy which discharges most unsecured creditors. Bankruptcy does not discharge certain debts including student loans, most federal and state taxes, alimony, child support and maintenance, penalties and fines, among others. Property can be sold to satisfy creditor's claims, although in many cases this does not occur.
